  6. [To help clarify the day's events, I held a short conference on IRC
  7. #auction.  The edited transcript appears below.  Thanks to
  8. panther@gate.net for compiling this. -Jason]
  9. This is the my log (using grapevine, powersnap, and a custom arexx script
  10. to put it all together) of the #Auction conversation with Jason Compton,
  11. editor of Amiga Report magazine on April 20, 1995.

  16.     ╟Join╚  jcompton (jcompton@jobe.shell.portal.com) has joined the
  17.             channel.
  18.   jcompton  OK.  Today, the only valid bid presented to the liquidators was
  19.             from Escom.
  20.   jcompton  Two other bids were presented.  One, from Creative Computers
  21.             (NOT CEI, a California-based dealer) was rejected because they
  22.             could not put up the necessary deposit.
  23. [NOTE: I was wrong, it wasn't Creative Computers.]
  24.   jcompton  The second, from Dell (PC-clone manufacturer) was rejected
  25.             because it dictated a 7-day investigation period on patents.
  26.   jcompton  The liquidators ruled that any and all conditions were
  27.             unacceptable, which is why Alex Amor and presumably David
  28.             Pleasance did not bid.
  29.   jcompton  So, Escom's standing bid of $5 million was accepted.
  30.   jcompton  NOW-Tommorow Judge Garrity will be ruling on the objections to
  31.             the sale.
  32.   jcompton  In addition to the objections from the C= US creditors, the
  33.             liquidators of Commodore BV/Philippines/Netherlands/UK, and
  34.             IBM...
  35.   jcompton  He will ALSO have objections from Alex Amor, very probably from
  36.             Dell, and possibly from David Pleasance.
  37.   jcompton  Essentially, Dell and Amor are both willing to offer more than
  38.             the Escom $5 million and can't fathom why their bids have been
  39.             rejected or invalidated.
  40.   jcompton  Amor told me he hopes to get the judge to open the courtroom
  41.             floor for bidding right there and then.  How likely this is, I
  42.             have no idea.
  43.   jcompton  <deep exhalation>  That's all I know.
  44.   jcompton  Sorry I don't have better news.
  45.    HammerD  jcompt: will this be all said and done tomorrow or do you think
  46.             it will take longer?
  47.   jcompton  Well...I mean, Garrity could throw out all of the objections
  48.             and then we're stuck.  Or, he could accept them...
  49.   JosherII  Why is this bad news?
  50.   jcompton  Josher: Because nobody has the first clue what Escom wants.
  51.      Intrd  jcompton but is that you that said that ESCOM is willing to
  52.             give out tehcnology to poeple like CEI?
  53.   jcompton  Intrd: Wasn't me.  CEI and Escom have had talks, but apparently
  54.             Escom was acting very coldly towards Alex today.
  55.       Zool  jcompton: shit...what else would Escom want to do with the
  56.             tech?
  57.   jcompton  Zool: We don't know.
  58.    HammerD  jcompt: was alex pissed?
  59.   jcompton  HD: "Exasperated" would be the word.  At the end of our talk,
  60.             he put me on hold for a few minutes, told me he got some new
  61.             good information and that there was still hope, and left.
  62.   jcompton  HD: I don't know if he's just being dramatic or what.
  63.      Pappy  Escom is incabable of continuing the Amiga(esp. development)
  64.   jcompton  Pappy: They seem to have enough money to do it, but they don't
  65.             seem to have the inclination.
  66.    Menacer  Jcompton: Are Dell just after patents or are they intrested in
  67.             selling Amiga's ?  I live in Austin TX (where dell is based)
  68.             and know quite a lot about the company ....
  69.   jcompton  Menacer: We don't know word #1 about Dell.  This is the first
  70.             I've heard of them interested, even in the wildest fantasy of
  71.             false information.
  72.      Intrd  Jcompton but is it aT DELL or Compaq tjhat some ex-Engineer of
  73.             C= working on the AAA were engaged?
  74.   jcompton  Intrd: That's Tim McDonald at Compaq.
  75.      Pappy  jcompton: Honestly, do you see Escom winning the entire
  76.             auction?
  77.   jcompton  Pappy: As of now, they HAVE.  I'm hoping the good grace of the
  78.             judge overturns it because it's silly.
  79.  NiteFlite  JCompton, so what's on Comp.sys.Amiga.misc is true?
  80.   jcompton  Nite: More or less, yes.
  81.   JosherII  JC: If they aren't planning to do any R&D do you think they
  82.             would be willing to sell the rights to do so?
  83.   jcompton  Josher: I know nothing about them.
  84.   jcompton  Nite: Alex objects and hopes that the judge overturns the Escom
  85.             deal and opens the floor for more bids.
  86.  NiteFlite  JC, so CUK and CEI did not bid because they are banking on the
  87.             objections to be upheld.
  88.   jcompton  Nite: No, Alex did not want to submit a bid without any
  89.             conditions.
  90.    HammerD  did not objections have to be in by last week?
  91.   jcompton  HD: Objections to the sale PROCESS, but if you were a bidder,
  92.             you can object to the bidding process as it happened.
  93.  NiteFlite  Alex, will then just wait to see who wins and negotiate with
  94.             them?
  95.   jcompton  Nite: No, I JUST SAID, Alex will hope that he can put in a bid
  96.  ╩╩╩╩╩╩╩╩╩╩╩on his own terms tomorrow.
  97.   jcompton  Nite: I don't know what Pleasance is doing.  I'd ask him if I
  98.             knew what hotel he was staying in.  :)
  99.      Intrd  jcompton so you know where is alex?
  100.   jcompton  Intrd: Yes...
  101.    HammerD  jcompt: you going to talk to Amor again tonight?
  102.   jcompton  HD: No, I think he'll be in meetings until he goes to sleep.
  103.             (He had a meeting at 2 am this morning, if that gives you any
  104.             indication...)
  105.   fallous_  The ONLY fucking way that the Amiga production would be slowed
  106.             is if Escom won, and of course they did.  Goddamn, this is
  107.             complete bullshit.
  108.   jcompton  fallous: You could have Dell if you prefer. :)
  109.   fallous_  jcompton: I'm still trying to figure out why Dell wanted it.
  110.   jcompton  fallous: Patents for lawsuits.
  111.   jcompton  fallous: Set-top technology, maybe.
  112.   jcompton  Mitchman: On the contrary, Commodore UK is up for sale, they're
  113.             part of Commodore International.
  114.  NiteFlite  JC, did Alex say how much he was willing to go?
  115.   jcompton  Nite: No.
  116.   toymaker  are all the companies at the auction listed in that news file?
  117.   toymaker  (in other words, is there another outside party besides Dell
  118.             and IBM)
  119.   jcompton  toymaker: Everyone who bid or should have bid, not counting the
  120.             people who showed up to try to bid piecemeal but never really
  121.             did.
  122.     skyman  JCompton: so did anyone not show that was expected to?
  123.   jcompton  skyman: No.
  124.   jcompton  toymaker: IBM's not bidding, they're objecting.
  125.      Gazer  jcompton: Cool, nect think you know we will get the soapie
  126.             "AMIGA: the true story"
  127.   jcompton  Gazer: Well, the prospects for a book keep getting better...
  128.     skyman  JCompton: were you there? how long was the session today?
  129.   jcompton  skyman: I wasn't there.  Once it started, it only took a few
  130.             hours because they just rejected everything but the Escom bid
  131.             and everyone had to go home.
  132.   jcompton  Mitchman: The patent license [IBM's license on Commodore
  133.             patents] is VERY broad.  I tried calling IBM's lawyers to get
  134.             some clarity, but they never returned my calls.
  135.   fallous_  who set the terms on whether a bid is accepted or not?
  136.   jcompton  fallous: The liquidator and his lawyers, subject to the
  137.             approval of US Bankruptcy Court Justice William Garrity, Jr.
  138.       oleg  Amiga might have had a hope if Dell won ;)
  139.   toymaker  oleg:  why is that?
  140.       oleg  toymaker, because Dell is a gigantic, solvent computer maker
  141.             with credibility.
  142.    HammerD  oleg *PC* company.
  143.       oleg  hammerd, what's your point?  they are big, they are solvent,
  144.             and they want Amiga
  145.   jcompton  oleg: They want Commodore's assets...that's not necessarily the
  146.             Amiga, especially at these prices...
  147.       oleg  i don't think CEI has the $$ to compete.  pure and simple.  the
  148.             best they will dois startup 1200/cd32 lines, saturate the
  149.             marketplace, tehn sell off the technology
  150.   jcompton  oleg: You could well be right.  Of course, nobody knows who's
  151.             backing Amor or Pleasance, either.
  152.         AH  jcompton: Again, Thank You!  YOU should get a Medal or
  153.             something.  :) Well, off to spread the news in My Home
  154.             Boards...  :)
  155.   jcompton  AH: I'd prefer a job...
  156.    Number1  oleg: One of the press releases I received from CEI (several
  157.             months ago) said they were prepared to spend $20 Million on
  158.             advertising during the first year if they won.
  159.   jcompton  #1: That's invalid now.  They don't have that sort of money to
  160.             blow.
  161.     Ahzwon  jcompton: So, out of all this, your *personal* opinion of
  162.             tomorrow's outcome?
  163.   jcompton  Ahz: As usual, it's not up to me.  I HOPE the judge does what
  164.             seems to be the right thing, and re-open the bids.
  165.      Intrd  jcompton didtn you said that Alex got support from IBMM
  166.             supposly to get amifa manifacture?
  167.   jcompton  Intrd: They signed on IBM as a contract manufacturer.  But no
  168.             mention of capital investment.
  169.   jcompton  Intrd: Same thing they do for the Atari Jaguar.  They take the
  170.             plans, build the machines, and take their money.
  171.        dib  wots the countdown to the auction, I wouldnt know wot time it
  172.             is in the US ( it midday Friday 21st here :)
  173.   jcompton  dib: The auction is over.  The court hearing commences in 11
  174.             hours, 30 minutes.
  175.     skyman  jcompton: who does have the most money ...or offered to spend
  176.             the most?
  177.   jcompton  skyman: Unknown.  Amor seems to be able to spend at least $7.5
  178.             million, around what he thinks Dell offered.
  179.   toymaker  jcompton: well doesn't that make it sound like the only way it
  180.             could be resolved tomorrow is if Escom wins
  181.   jcompton  toymaker: Not necessarily.  If things go Amor's way, the
  182.             courtroom floor will become the bidding ground.  I presume
  183.             there's some precedent his lawyers have informed him of, I
  184.             doubt he made that up himself.
  185.   jcompton  toymaker: I'll wait another week if it's not Escom.  A company
  186.             as relucant to talk to ANYONE about ANYTHING as they are just
  187.             doesn't make me feel better.
  188.   toymaker  jcompton:  Such a scenario could be set up in a day?
  189.   jcompton  toymaker: <shrug> Again, I'm not a bankruptcy lawyer.  But he
  190.             seemed convinced that it was at least possible.
  191.    NewOrde  who is dell and what are there plans
  192.   toymaker  NewOrde:  Dell is a PC clone manufacturer
  193.   jcompton  New: And nobody knows what they want.
  194.   JosherII  jcompton: What, in your opinion would be the next viable system
  195.             to invest in..  A PMac or a Pent.  on OS/2?
  196.   jcompton  Josher: Whatever makes you feel good.  Seriously.  I haven't
  197.             switched because at the moment I'm having a great time doing
  198.             this on my 3000.  Play with both and see what you like.
  199.    HammerD  jcompt: what time is the hearing tomorrow?
  200.   jcompton  HD: It's supposed to start at 10:00 EDT, so in 11 hours 30
  201.             minutes.
  202.      Intrd  jcompton hey if i come during lunch time do you think i might
  203.             have some scoop?
  204.   jcompton  Intrd: Maybe.  Zool is going to the hearing and hopes to have a
  205.             laptop, but...well, for the authoritative, condensed,
  206.             summarized, AR'ed version, you have to wait.  :)
  207.   toymaker  I wonder if anyone's videotaping the auction.  :)
  208.   toymaker  that would be interesting to watch...
  209.   jcompton  toymaker: No cameras allowed.  No recording equipment of any
  210.             kind allowed.
  211.         JP  jcompton: who exactly made the decision to accept Escoms bid,
  212.             the Judge?
  213.   jcompton  JP: No, the liquidator and his lawyers.
  214.   jcompton  JP: The judge hears everything tomorrow.
  215.        mUb  Ahzwon: Thats what im trying to say to these people, it may not
  216.             be so bad after all.....
  217.   jcompton  Mub: Escom has rejected all contact with Amiga users.
  218.   jcompton  Mub: Does THAT makes you feel good?
  219.    HammerD  jcompt: he may take time to "rule" on these objections.. :(((
  220.   jcompton  HD: He's had a week to read half of them...
  221.        mUb  JC: Indeed no, CBM were just like that....
  222.   jcompton  Mub: I have had AR reps call, other perople have tried...they
  223.             have lied about their interest and now just won't talk about
  224.             it.
  225.    steiner  jcompton: so I was correct? E! won't make/sell Amigas?
  226.   jcompton  steiner: Well, we don't know at all.
  227.   toymaker  Is Gould at the auction?
  228.   jcompton  toy: I don't think so.
  229.   toymaker  jcompton: yah..  his life would probably be at risk or
  230.             something..  :)
  231.    NewOrde  Does anyone know anything about the AOS project that C=Uk have
  232.             had underway for a while know is it gonna be released with the
  233.             A4000 and A1200
  234.   jcompton  NewOrde: Commodore UK's head of developer support forwarded a
  235.             letter from David Pleasance saying "We think what you're doing
  236.             is great, hey, we're going to get the Amiga so we'd like you
  237.             to help develop for us."
